H.R. 218 "Law Enforcement Officers Safety Act" This Federal law exempts
qualified active and retired Law Enforcement Officers from local and
State prohibitions on the carrying of concealed firearms while
off-duty across state lines. However, this does not mean that all
states have to change their carry laws to reflect the Federal law.
This is a Federal law that exempts qualified active and retired law
enforcement officers from local and State prohibiitions on the
carrying of concealed firearms.
However, many questions still exist about
applying the law in each state; plus there are gray areas concerning
Reserves/Volunteer Law Enforcement.
Signed into law by President Bush in 2004, H.R. 218 gives
off-duty, as well as retired, Police Officers right to
carry concealed firearms in most situations in all 50
states. It preserves any State law that restricts concealed
firearms on private property and any State law that restricts the
possession of a firearm on State or local govrnment
property.
To qualify for
the measure's exemptions to permit a qualified off-duty law
enforcement officer to carry a concealed firearm, nothwithstanding
the law of the State or political subdivision of the State, he or
she must have authority to use a firearm by the Law Enforcement
agency where he or she works, not be subject to any
disciplinary action; satisfy every standard of the agency to
regularly use a firearm, not be prohibited by Federal law from
receiving a firearm; and carry a photo identification issued by the
agency. The bill preserves any State law that restricts
concealed firearms on private property, and any State law that
restricts the possession of a firearm on State or local
government property or park.

initiative go to http://leahy.senate.gov/press/200407/070804.html.
Remember, many questions still exist
about applying the law in each state; plus there are gray areas
concerning Reserves/Volunteer Law Enforcement. Consult your
agency's current policy on same and contact your State's
AG.
